These terms apply to your use of Photy, published by Miguel De Leon. They add to Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), which also applies. By using Photy you accept both.

Photy is a photo booth and photo editor. Its film looks, editor, photo booth and Beauty tools are free. AI trends use credits and turn a photo you choose into a new image with AI.

• An AI trend costs the number of credits shown before you start (usually 1; outfits cost 2). "Try again" costs the same as a new trend.
• Plans (Plus and Gold) are weekly auto-renewing subscriptions that give a number of credits each day. Daily credits reset at midnight UTC and don't roll over.
• Credit packs are one-time purchases. Pack credits never expire. Daily plan credits are used before pack credits.
• Prices are shown in the app in your local currency before you buy. A plan may start with an introductory price for the first week, shown before you buy.
• Credits have no cash value, can't be transferred between accounts except by restoring purchases, and are lost if you delete your account.
• If an AI trend fails or can't be completed, its credits are returned automatically.

Payment is charged to your Apple ID at confirmation of purchase. A subscription renews automatically every week at the price shown unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period. Manage or cancel in Settings › your name › Subscriptions. Cancelling stops future renewals; you keep your plan until the end of the period you paid for. Any unused part of an introductory period ends when you buy another plan, where applicable.

Purchases are processed by Apple, and refunds are handled by Apple under its policies (reportaproblem.apple.com). If Apple refunds a credit pack, the credits from it that you haven't used yet are removed.

You keep all rights to the photos you use and the images you create. You give us permission to process the photos you choose, only to create your results and run the service, as described in the Privacy Policy. You're responsible for having the right to use every photo you upload.

Don't use Photy to:

• use photos of other people without their permission, or of anyone under 18 in a sexual or harmful context;
• create images meant to deceive, harass, impersonate or defame anyone, or to pass off as real photos in a harmful way;
• create illegal, sexual, violent or hateful content;
• get around the app's limits or credit system, or reverse-engineer or abuse the service.

We may refuse a request, remove a result, or suspend access if these terms are broken. The AI may refuse some photos on safety grounds; your credits are returned when it does.

AI results are generated automatically and can be inaccurate, unexpected or imperfect. They're provided for personal creative use. Results may carry an invisible watermark added by the AI technology.

We may change, add or remove features, trends and prices. Price changes to a subscription follow Apple's rules and notices. We may update these terms and will post changes here with a new date.

Photy is provided "as is". To the extent the law allows, we aren't liable for indirect or consequential damages, and our total liability is limited to what you paid us in the 12 months before the claim. Nothing here limits rights you have under consumer law that can't be waived.

These terms are governed by the laws of Colombia, without affecting mandatory consumer protections where you live.
